The vast majority of lawsuits are settled before trial. Unfortunately, the parties too often spend a fortune in attorney’s fees and litigation costs before the case is resolved. Many lawsuits, or pre-lawsuit disputes, can be settled before all that money is spent, and often wasted.
I know. I’ve been an attorney in Santa Fe, New Mexico for more than 30 years. I represent clients in all sorts of disputes, lawsuits, arbitrations and mediations involving business relationships, commercial transactions, real estate, construction, developments, community associations and employment. I also know, based on my extensive experience, that mediation provides a venue for the parties to engage in productive and focused settlement negotiations to resolve their dispute with the help of a neutral mediator to guide their discussions.
I believe that a mediator should be more that just a messenger between the parties. Rather, my role as a mediator is to listen to the parties, learn the details of their dispute, including the factual and legal basis for the parties’ claims and defenses, understand the parties' objectives and offer what I believe to be an impartial evaluation based on my many years of experience, all with the goal to create a forum in which parties can resolve their dispute. I am not an arm-twister because I believe that the decision to settle a dispute must be made by the parties themselves based on their informed and willing consent. But I will tell you what I think about your case.
I charge $300.00 per hour plus applicable New Mexico gross receipt tax for my services as a mediator, which is typically split by the participating parties. My services include the review of materials to be provided by the parties in advance of the mediation and my time spent during the mediation. An advance payment is typically required based on the total anticipated amount of time for my services including pre-mediation review of materials. Any unused balance is refunded to the parties. Mediations may be held in person or remotely, and representation by counsel is not required. The parties may be responsible for room rental charges if rooms need to be rented for the mediation. All of the parties participating in the mediation will be required to sign a mediation services agreement provided by me.
